New York City is very adamant about keeping an obstruction free sidewalk. Unfortunately for property owners, ATM’s are classified as an obstruction. If an ATM is found on a public sidewalk, the property owner will receive an Encroachment Notice from DOT. This notice requires the owner to remove the ATM from the public sidewalk within 30 days. Failure to comply with the notice will result in a $2500 fine and another $5000 for every five days the violation continues. Try to avoid this fine and make sure your ATM is on your property, Thank You.
